| Where to File: | Where to send your completed I-765 depends on why you are eligible to apply for employment authorization. Most applicants will submit the form to an INS Service Center with jurisdiction over your state of residence. If you are filing based on your having: Temporary Protected Status; been granted withholding of deportation; dependent of A-1 or A-2 Foreign Government Official; dependent of G-1, G-2 or G-4 Nonimmigrant; paroled in the public interest; granted voluntary departure or deferred action; adjustment of status based on continuous residence since January 1, 1972; or a final order of departure, then file your application with the local INS District or Sub-Office with jurisdiction over your place of residence. If you are filing under the special ABC filing instructions and filing your asylum application and EAD application together, mail this form to the office where you are filing your asylum application. If you have applied for adjustment of status (I-485), file this application to the same local INS District Office or Service Center where you submitted your I-485. If you are applicant for suspension of deportation and you are a NACARA 203 applicant or if your I-881 application is still pending with INS, and you live in AK, AZ, CA, Guam, HI, ID, IL, IN, IA, KS, KY, MI, MN, MO, MT, NE, NV, ND, OR, OH, SD, WA, or WI, mail your application to the California Service Center. Otherwise, mail your application to the Vermont Service Center. If you are an applicant for suspension of deportation and you are not a NACARA 203 applicant, apply at the local INS District or Sub-Office with jurisdiction over your place of residence. |
| Filing Fee: | $100, unless you are in one of the categories noted below: If filing for an initial EAD under one of these categories: - refugee, asylee or paroled as a refugee;
- N-8 or N-9 Nonimmigrant;
- Citizen of Micronesia, Marshall Islands, or Palau;
- Granted Withholding of Deportation;
- Deferred Enforced Departure;
- Dependent of certain foreign government or international organization personnel; or,
- Applicant for asylum (applicant filing under special ABC procedures must pay the fee however).
If filing for a renewal EAD under one of these categories: - Citizen of Micronesia, Marshall Islands, or Palau;
- Granted Withholding of Deportation;
- Deferred Enforced Departure; or,
- Dependent of certain foreign government or international organization personnel.
If you are filing for a replacement EAD, and you are a dependent of certain foreign government or international organization personnel, no fee is required.
